Terms of Service

1. Agreement to Terms

By accessing or using CarQR, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms or our privacy policy, you may not access our service.

2. Eligibility

You must be at least 18 years old to use CarQR. By using our service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.

3. Account Terms

  • You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
  • Account sharing is strictly prohibited. Each account is intended for use by a single individual.
  • You may create multiple car profiles under a single account, as long as you own or have permission to create profiles for those vehicles.
  • Automated access, bots, crawlers, and any form of automated scraping are not permitted without our explicit written consent.
  • You must provide accurate and truthful information when creating car profiles. You represent that you own the vehicle or have permission from the owner to create a profile for it.

4. Service Usage and Content

CarQR is a free service that allows you to create public profiles for your vehicles and generate QR codes that link to these profiles.

  • Public Nature: Car profiles you create are publicly accessible on our website. Anyone with the URL or QR code can view your car profile and the information you choose to include.
  • Content Responsibility: You are solely responsible for all content you upload, including images, videos, text, and any other information you provide in your car profiles.
  • Prohibited Content: You agree not to upload, post, or share any content that:
    • Is illegal, harmful, or violates any applicable laws
    • Infringes on intellectual property rights of others
    • Contains false or misleading information
    • Is defamatory, harassing, or abusive
    • Contains malware, viruses, or other harmful code
    • Violates privacy rights of others
  • Rate Limiting: We implement rate limiting to prevent abuse and ensure fair usage. Excessive requests may result in temporary restrictions.
  • We reserve the right to modify, suspend, or discontinue features at any time without prior notice.

5. Intellectual Property

Your Content: You retain ownership of all content you upload to CarQR, including images, videos, text, and other materials you provide in your car profiles. By uploading content, you grant CarQR a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on our platform for the purpose of providing our service.

Platform Ownership: CarQR retains ownership of the platform, including all software, design, functionality, and intellectual property related to the service. This includes but is not limited to the QR code generation system, website design, and platform features.

QR Codes: The QR codes generated by our platform are provided for your use. You may use these QR codes for personal or commercial purposes related to your vehicle, but you may not resell or redistribute the QR code generation service itself.

6. Account Termination

We reserve the right to suspend or terminate accounts at our discretion, particularly in cases of:

  • Violation of these Terms of Service
  • Suspected illegal activities
  • Abusive behavior or misuse of the service
  • Uploading prohibited content
  • Impersonation or misrepresentation
  • Attempts to circumvent security measures or rate limits

Upon termination, we will delete or anonymize your account data after fulfilling all legal requirements. Any illegal activities will be reported to relevant authorities. You may also delete your account and car profiles at any time through your account settings.

7. Service Availability

While we strive to maintain consistent service availability, we do not provide specific uptime guarantees. The service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. We are not liable for any loss or inconvenience resulting from service interruptions.

8. Disclaimer and Limitation of Liability

CarQR is provided "as is" and "as available" without warranties of any kind, either express or implied. We expressly disclaim any liability for:

  • Accuracy or completeness of information displayed in car profiles
  • Any loss or damage resulting from the use or inability to use our service
  • Service interruptions or data unavailability
  • Any unauthorized access to or alteration of your content or data
  • Any consequential, indirect, or incidental damages
  • Decisions made by third parties based on information in your car profiles

To the maximum extent permitted by law, our total liability for any claims arising from or related to the use of CarQR shall not exceed the amount you paid to use the service (which is currently zero, as the service is free).

9. Indemnification

You agree to indemnify and hold harmless CarQR, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

  • Your use of the service
  • Content you upload or share
  • Your violation of these Terms of Service
  • Your violation of any rights of another party

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any significant changes via email or through our service. Continued use of CarQR after such changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using the service and may delete your account.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
